Public prosecutors indicted former Nissan Motor Co.

Carlos Ghosn's chances of getting out of jail anytime soon took a serious blow on Friday after he was indicted for a second time by Japanese prosecutors building their case against the fallen auto executive, who was detained nearly two months ago.

Japanese prosecutors on Thursday temporarily suspended their interrogations of Ghosn, who began feeling ill on Wednesday night, according to the office of his lawyer Motonari Otsuru. The former auto tycoon has been charged with aggravated breach of trust, and with violating a financial law by underreporting his compensation.

The automotive heavyweight was served with a fresh arrest warrant for allegedly under-reporting 9 billion yen (83 million US dollars) of his remuneration during the three years through March 2018.

Friday marked the last day of Ghosn's most recent detention period approved by the Tokyo District Court, and prosecutors had to decide whether to indict or release him.

At his dramatic court appearance on Tuesday, Ghosn appeared to have lost a lot of weight in detention but otherwise seemed in good health.

Mr Ghosn, the architect of the Renault-Nissan alliance, is accused of moving personal investment losses worth 1.85bn yen (£13.4m; $17m) racked up on foreign exchange dealings to Nissan.

He was first detained on 19 November and rearrested twice in December.

Ghosn's lawyers have filed a bail application but acknowledged that his detention would most likely continue until trial.

Ghosn said he was "wrongly accused and unfairly detained based on meritless and unsubstantiated accusations" during a court proceeding earlier this week, the vehicle executive's first public appearance since his November arrest.

If proven, each of Ghosn's alleged offense may carry a sentence of as much as 10 years, prosecutors have said.

Kelly and Nissan were not charged with breach of trust.

The court rejected an appeal by Ghosn's lawyers for his release from detention, and on Thursday turned down another appeal.

Ethics officials at Nissan's alliance partner Renault SA of France concluded this week that financial compensation to members of the French carmaker's executive committee in 2017 and 2018 was fraud-free.

He did not respond when asked whether Ghosn, who has been arrested three times, could be served with another arrest warrant. The indictment also alleges that Ghosn used company funds to repay a Saudi acquaintance who put up collateral for the contracts.

Nissan said earlier that its board had also met Thursday, when directors had received "an updated report" on its own investigations into Ghosn's alleged misconduct. In a statement, Nissan said that Munoz had "elected to resign" from the company, effective immediately.

It said it took the charges filed against the firm "extremely seriously" and was continuing its investigation into the case.
